Would appreciate the input on my querries by the attorneys & the people who has experienced similar situation.
My spouse's Advance Parole is expiring in mid February 2010. He is pplanning to travel to India by mid - jan & return back by 3rd feb'2010.
My questions is:
1) Is the time gap of 15 days before the expiry of the AP is safe to re-enter USA?
2) SHould he apply for the renewal of the AP before he leaves? If yes, then if the advance parole renewal approves before he re-enters the country, can he still re-enter on the old Advance Parole document or the old one gets automatically nullified?
3) Should he be in the country during the time the advance parole approves?
The situation is very urgent. Immediate feedback is highly appreciated.

I left the U.S on October 30 2009. My L.C. [Perm] had been filed on July 30 2009 and was recently approved.
My 6 year H1B expired on Feb 2 2010, with approximately 160 days available for recapture.
My company needs me to return to the US urgently and is wanting me to apply for a Business Visa.
Subsequently when I am in the U.S, they intend to file for I140 and then 7th year H1B
extension plus recapture time based on pending I140
Is this feasible? -- What impact would it have on my green card application process?

Hi,
I am curently on h1b visa on 7th year.My i-140 got approved 3years back and filed i-485 in 2007 and waiting for gc.Now if i switch my job to different employer using my EAD,Can my previous employer revoke my i-140 affecting my gc processing.Does he still have control to withdraw.Can you please help on this.Thanks.

I received RFE letter from USCIS for missing TB skin test result in the medical reports.I took TB skin test in 2007 and came out negative.Here is the test of RFE
"your application contained form I-693 in which the required TB skin test was not conducted. Please note there may be conflicting information on some published form I-693 instructions regarding when the chest X ray Report should be performed. It is required only when the TB skin test indicates a reaction equal to greater than 5 mm, or when the reason for why the TB skin test is medically inappropriate to perform has been annotated on theform I-693. Please submit a newly completed form I-693 indicating the results of the required skin test."
After consulting the doctor concerned, she filled up new I-693 form with 2007 test results and provide me I-69e form in a sealed envelop. Can you please let me know whether 2007 TB skin test results will be acceptible to USCIS or do I need to do another TB skin test? Please Help.

I know this one guy has done this he worked on h1 for 6 years after that he didnt get extension so he changed his status to f1 as full time student ...now he is on f1 visa...so dont worry.

Hi,
My husband was had complete his MS from US and moved to H1 , recently went to India for and his H1 visa is rejected. I am on L1 so now he got his L2 visa approved.
I wish to know the following -
In order to start working as soon as possible what all options he has.
I long will L2 EAD will take?
Can he switch back to is orginal H1 once he come back to US? or he has to apply new H1.
Can he apply for both H1 and EAD. If so which one will be taken in to consideration if both are approved?
Please give you expert advice on what to do next.

The Congressional Record, for instance, is printed daily and captures every debate, vote, parliamentary maneuver, tribute to a fife-and-drum corps, post office naming, and utterance by members on the floor of the House and the Senate. It averages 250 pages.
Ordinarily, the legislative process is paper-intensive. From the moment a bill is introduced by a member of Congress to its signature on parchment paper by the president, the printing office must print 10 different documents related to that piece of legislation, often doing the work overnight.
The agency is producing 3 million or 4 million pages a week for Congress from its 1.5 million-square-foot North Capitol Street headquarters, the largest information-processing, printing and distribution facility in the world. Tapella could not say how that compares with the workload under the last Congress.
All the talk of paper led some members of the panel to question why the printing office, which was created in 1813 when printing was a central tool in communication, hasn't gone all-electronic.
"Are you completely transitioning to a digital system as some point?" the subcommittee chairman, Rep. Debbie Wasserman-Schultz (D-Fla.), asked during a hearing.
The printing office is in the middle of a $29 million technological shift that will allow it to store and maintain all federal documents electronically, Tapella said. About 92 percent of everything it publishes now is available in an electronic format, said Michael L. Wash, the agency's chief technical officer. The agency produced its first online edition of the Congressional Record two weeks ago.
But Turri said the printing office will stick with paper until Congress directs it to do otherwise.

Ok, Lots of people have been telling good ideas.....Here is one more.
As part of our campaign on these legislations (HR 5882, HR 5921 & HR 6039 ), I wrote to my congressman. Afte sometime I got a reply and I was suprised that he had personally signed it. I know many IV members have contacted their congressman/Senators and they might have got a reply back.
My idea is that we should all mail the responses we got from our law makers to IV core. They can collect these letters, highlight the positive responses the lawmakers have said and send them to the chairman of "Judiciary" committee. This way IV can raise its stature and be know as a organisation for Legal Immigrants who are doing the right thing by contacting the law makers.
Makes sense ?

I just got a letter from USCIS saying that I need to get a police clearance(b/c my fingerprints are unclassifiable) within 30 days otherwise it may result in the denial of my application.
I am now out of states working for my U.S. employer's overseas branch and can't go back to US until end of Aug. Is there anyway I can ask USCIS to give me some extention period?

Hello folks. I hope someone can help me out on this issue. I applied for my wife's EAD back in July 2007. The EAD was processed in two weeks and we received the card. However, my wife's middle initial was incorrect and we sent it back to USCIS with an explaination concerning the mistake. USCIS stated that it would take anywhere from 2 months to 6 months to process the correction. Last week I received a letter from USICS stating that I need to submit a completed I-90 form. A I-90 form is used to replace a green card. We just applied for our adjustment of status in 6/2007 and are not permanent residents at this point. Getting the EAD has become a nightmare for us. Do I try and write a letter back to USCIS stating that they are asking for the wrong form. I tried to call them but they said to respond to the letter sent. I'm stuck between a rock and a hard place. Any help/advice would be appreciated.
