Hello,
My wife's Advanced Parole document has wrong date of birth. Her EAD card too had wrong DOB; we have sent it back to USCIS. She's planning to visit India next month. She has a valid H4 visa stamp.
Is it ok for her to travel to India? Do you see any issues while coming back.

Be very very careful.. There are lots of carcasses along the highway of pre-approved labor..
In any case.. I have almost never seen this work when people enter it solely based on labor based logic, If every thing else is fine like project/attitude/salary and approved labor is add-on.. then you got lucky.. and Good Luck!
But rule of thumb is .. if it's too good to be true.. mostly IT IS..

One of the stand out football players for the United States Military Academy at West Point is junior Alejandro Villanueva, a Spaniard who played high school football in Belgium. The wide receiver is also the tallest player in all of college football - 6 foot, 10 inches. I am in a weird situation here, I was Laid off on July 21st with pay in lieu until 4th August. I had applied for Change of Status to F2 (my wife is on F1) on 17th August. On 31st August I got a job offer and applied for H1B transfer to USCIS on 8th September (using 15th august paystub as the latest).
At the same time i filed to USCIS to revoke my F2 application.
Today I got a notice from USCIS that my application for change of status to F2 is approved as of 09/21/2009.
Now, I dont know what to do, does it mean I am now on F2? Is my H1B transfer application still valid or I need to apply again this time on premium processing.
What should be my next course of action. Any help in this regard would be highly appreciated.

Labor, I140 approved and I-485 filed during July-07. Have EAD and AP but never used it. Still on H1B, extended for 3 years based on approved I140 and valid until Dec 2011. With my GC employer all along, employer is applying for LCA now as my new client is located in different state. My questions are:
� Whether there will be any impact on my ongoing GC process if the job description on this new LCA is different?
� If anything goes wrong with this LCA, whether there will be any impact on my existing H1 and eventually on GC process?
� If something wrong happens to my H1, can I still switch to EAD after that?
� What is the process to move from H1B to EAD within the same company, is filing new I-9 with EAD detail is suffice?

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? How about this ? Lets say your consulting firm is ready to file your I-485 upon lots of restriction such as two year agreement and to spend around 10 gran.
While the big firm who has filed the PERM and waiting for the approval. In this case, can we do both the cases to see which is better upon the current situation.
This will help few of our folks and your thoughts are always appreciated.
