I am wondering what happens if I buy some real estate property ( a condo unit) while I am on H1B, and if i moved out of country, (H1B - 6Yrs completed) do i need to sell the property (condo) before i leave country? Can i rent this unit while i am away from country? On a new H1B can i come and stay in that home? Anybody experienced this case before? Please give me details as much as possible. Thanks.

Dear IV members
This is for my wife. Her 485 is pending with TSC. PD is EB2 India March 15 2004. Has been current since September 1. After the USCIS website update recently received Document production or Oath Ceremony status update online. And message saying a document has been sent etc.
Since she was current we thought it might be good. 30 days later nothing received. Raised SR since we didnt receive anything. The customer service rep as usual didnt know anything. Said they haldn't received anything back. They opened SR. We got response 3 weeks later.
In the response letter it says that another notice will be forthcoming to tell you to go to local ASC.
Havent received anything. Do you think right now should I again pursue after them by writing to Ombudsman etc especially since case is current? Mainly I am afraid that since the status says Document production would some IO think that the case is already approved and so stop working on that case? Please advice. Thanks in advance.

I have a offer from an employer and they say that they will be able to provide documentation for GC processing but will not be able to sponsor. What does that mean? Can i hire attorney for my GC processing(EB2) and pay the expenses by myself? What else would be required from the employer?

I know for a fact that you cannot count current employer exp for GC. If i start working for the same employer on XYZ is it more than 50% different in role so i can count my 3 years experience when applying my GC ??

I have a question, actually I worked with a for-profit company A for few years and then transferred my H1B to a not-for-profit company B last year. Now can I transfer my H1B to a for-profit company C?
Actually one of my friend told, it is not possible and I can transfer only to the not-for-profit companies as I am currently working with a not-for-profit company B. Is this true?

I calculated my time in USA excluding time spent outside the country and my 6 years will end in June 2010. When my employer renewed H1 back in 2008 he simply claimed for 3 years and USCIS approved till 03/2011. But I read somewhere online that we have to calculate our time spent in the country and should not go by the date that is on our H1.
1. Does the change of status from H1 to F1 reset the H1 time period or do we have to consider that time period while calculating the 6 years
2. As my application (AAO) is pending I heard I will get a one year extension. The question I have is can I stay on my current H1 till 03/2011 or do I have to renew my H1?

I received my EAD today, but my I-140/I-485 are pending. Is the EAD of any use right now? I think I have to wait for the I-140 to be approved before changing jobs, right?

Hi,
I have applied for my H1B transfer from my current employer to a new company. I have not had any issues with my current employer with pay or anything like that. I have maintained my H1B status with my salary coming on time as promised and have all the paystubs and correct documents. My new employer is a big american MNC and they have hired a well known law firm for transfer process.
My only question is I have not informed my current employer yet and will inform him in a weeks time once my LCA is done and transfer is filled. He will not be very happy about this and I have initially signed an offer letter which says I will work with him for atleast a year and its only been 6 months so far. Can he create any problems in my transfer by cancelling my current H1 or any other problems with my reliving? Pls help.
