The early retirement of US Senator Mel Martinez (R-FL) has opened up an appointment opportunity for Governor Charlie Crist, himself a candidate for Martinez's seat. Crist will likely not appoint himself and a number of names are circulating for potential replacements. According to Politico, one person being considered is Jacksonville-area State Representative Jennifer Carroll. Carroll would be the first black female Republican Senator if she were selected. Carroll is a native of Trinidad and a retired US Navy officer. Belgian-born Diane Von Furstenberg was profiled yesterday in the New York Times as an example of a fashion designer who is actually doing well despite the economic downturn. Furstenberg has been a major figure in American fashion design for nearly four decades. Her designs are worn by famous women like Jessica Alba, Madonna and Jennifer Lopez. If we lose our job after having the I-485 pending for more than 8 months, I-140 approved, how much time do we have to find another job?
Do we have to immediately withdraw the petition after losing/quiting a job?

My I-140 is approved. And we are planning to change my wife's status from H4 to F1 student. Is it ok to do that ? I heard that it will be problematic for my wife to go back on Green path. Please advise.I also heard same thing but talking to a attorney is good than posting here..

Hi,
I am on H-1B with a company and have been through my 4years of H-1. Now they are saying that they might not be able to apply for my PR before the start of my 6th year of H-1 and are offering me the following option: Need to leave US and go back to India or any other country, will be paid US salary and then after one year will be brought back on a L-1A visa. Now my question is can they pay in US dollars while i am outside US and still be able to come back on L-1A visa? or do i need to change into local payroll?

It would be very tough to get CP appointment before the end of July. So I am not even thinking of CP. Also CP needs to be approved when your PD is current.

Opponents of Arizona's SB1070 immigration law scored another victory in the courts yesterday. In the case of Friendly House v. Whiting, the court overruled a motion to dismiss the case challenging the law. The judge noted that "Racial discrimination was a motivating factor for [S.B.] 1070�s enactment" which establishes a legitimate constitutional challenge to the law. While this is only the opening round in the case, it does suggest that the defenders of the law will have a tough time convincing the judge that the law is constitutional. 10-1061-447 -

Hello all:
My friend currently is in his home country. He worked with H1-b before, and left US because of being laid off (could not found a new job in time). His question is if he can apply for B2 and go to the US first, then stay in US looking for a job. After getting an offer, transfer his previous H1-b to a new company. Can he do like that? Thanks!

Hi,
My fiance has filed for h1 extension. we will be travelling to india for marriage by dec. since petition papers are not expected to come by December, i was thinking if the following can be done
1. she comes along with me under h4 visa.
2. once petion paper comes, her visa status changes from h4 to h1 and then she can continue her job.
is this possible?
will h1 visa processing continue to happen when one comes to US under H4 visa.
kindly suggest.

Dear All,
As I work for a consulting company and my previous lawyer was my employer's ass kisser, I decided to go for a new lawyer.
(1) Will the new lawyer need any documents from old lawyer? As such I have copies of everything till now
(2) My employer is in Dallas and I am on a project in New Jersey, but my petition is for my permanant work location in Dallas - is it advisable to choose a lawyer from Dallas (future employment area) or NYC/NJ where I currently have my project (i plan to stay here for a while) - what is the general take - physical accessibility to lawyer or choose lawyer close to company location?
(3) How hard is it to find lawyers? Last month when dates moved considerably - I heard lawyers have been stressed and over burdened over the mad rush of petitions and have been least responsive - will lawyers take new cases in such situations???
(4) Can anyone suggest a communicative lawyer? The best of all :)

as far as I understand it, you will be eligible for AC21 in feb. As long a they do not withdraw your 140 you should be ok. Just switch to a different employer and invoke AC21 in feb. Disclaimer: consult an attorney to confirm.
