All the while we saw people talk about new job matching LC job and not H1 (LCA) job. But it would be nice and safe if you have similar job on LC,LCA, new AC21 job. But mainly the job in LC should be considered as per my knowledge.

i m new to this forum. I know that when I-485 pending and EAD pending for 90 days, u can get temporary EAD from local USCIS office.
in similar way, can u also get temporary AP (advanced parole) if application pending for 90 days.

I sent the applications(I-140,I-485,I-131,I-765)to Nebraska center 3 weeks ago and it was received by them on December 17,2007(because I tracked the FedEx package).Until today,no receipts yet and my checks are not cashed yet and the receipting update says Current for Nebraska, is the normal or there is something wrong?

Hi,
My employer filed H1B transfer in Feb 2009. however he could not receive RFE letter with in time on mail and only received after RFE submitted date was expired which is May 25th, 2009
In jun1 1st week , he filed for the RFE extension for the stated reason and also refiled H1B to make sure that I should be in valid H1B status in case of first H1B denial in mean time
Employer submitted all the documents related to RFE on June 20th and it got approved on jul 1st.
What are the best options for H1B refiling case
in case if it is denied, will it super impose the original H1B approval ?
is it good idea to cancel/revoke pending H1B refiling case ?

Can a person join a new employer for doing his LC, based on already sent out ads ???
what they are telling me is that the ad is very general for EB2 which was sent out even before one joined the company. so my question would be that can a person go ahead and use the already sent out ads or one should raise some red falgs, not to go for it ???

I am travelling to Penang on the 14th September, and I wonder how long it will take the consulate to process this visa application. Also, if I take the papers on a Friday morning, are they open for me to collect the visa on a Saturday ?

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

I heard from my collegue that if your company is doing Lay Off's, then your 485 processing stops automatically.
is that true? can anybody confirm it.
My PD is Aug 2005, I40 Approved and 485 was filed in Set 2005.

She will have to go out of country and get stamping for H4 if her spouse is maintaining H1.
Automatic validation does not happen..
I need help for my friend. My Friend's spouse on H4 started to work on EAD. She does not work (or if she gets laid off), will she automatically get her H4 status? If not, what does she need to do to get back on H4. Her husband is on H1.

This is my third EAD renewal. My 485 is pending at NSC. I am in CA. All my previous EADs/APs etc were filed at NSC.
This time when my EAD renewal is filed (by my new attorney, in new company) I got receipt Number starting with MSC.
Who decides where to file MSC? What's the criteria to file at MSC? Shouldn't it be file at NSC?
Is this a mistake?
No it is not. It is the National Benefits Center receipt number. Mine got transferred from the TSC.

Hello everyone, thanks in advance for any reply.
I mailed in my wife's I485 and I130 together (she's from China, and we just got married a month ago), and I just realized that I forgot to include the marriage license with the forms!
Now, what are my options? I noticed that they have not cashed my 2 checks yet, should I cancel them so I at least don't get charged for the forms that will be rejected?
Or, is there any way for me to mail the marriage license separately and hope they get it?
Right now, I think it would be better to just redo the forms, but do I have to wait for the forms to get rejected first?

Labor category has little to do with AC21. Your responsibilties should be 'similar', which is kind of a vague term, which means USCIS would generally not mess with anything that has enough of the same words used in description.
