hi,
i entered the US on AP in Jan 2010, and at the time of entry, my I94 validity was set for
1 year (viz Jan 2011) - and the AP also noted "AoS" status on it.
(a) Is the validity of my I94 (and thus my legal stay) 1 year, or as i have read elsewhere,
if AoS is pending, then its valid till the AoS case is decided?
(b) If the validity is 1 year, what is the process for extending the I94 validity?

H-1B visas are a relatively swift path to employment for foreigners with bachelor's degrees and U.S. employers to sponsor them. Each year, the U.S. government makes 65,000 H-1B visas available to qualified individuals on a first-come basis. The cap has been reached every year for the last several years, and for fiscal year 2008, it was reached on the first day of filing. As of July 10, 2009, U.S. Citizenship and Immigration Services (USCIS) had received 44,900 H-1B cap-subject petitions that have been counted towards the 65,000 H-1B cap. USCIS continues to accept cap-subject petitions.

My attorney is asking $500 for filing both EAD and AP as filing fee. So was wondering how difficult it is to file by my self. Does anyone has expereince filing for renewal.?

FIRST GUN CONTROL, now fuel economy. Congressional Democrats still have a lot of work ahead to get their groundbreaking bills past both houses and the president's desk, but you can't say they're not leading a radical change in direction.
On June 13, the House passed what could become the first major gun-control law in a decade, a bill aimed at strengthening a federal database used in background checks for gun buyers. A week later, the Senate approved an energy bill that would improve mileage for the nation's automotive fleet for the first time in nearly 20 years. Democrats still haven't forced a troop reduction in Iraq or put their stamp on the nation's backward immigration policies, but their surprising success in other areas is worthy of praise.
Not that Democrats deserve all the credit. The gun bill was a bipartisan effort that passed by acclamation after it won the blessing of the National Rifle Assn., while 20 Republicans � nearly half the 43 who voted on the measure � backed the fuel economy bill. Still, these measures would have been inconceivable while Republicans controlled both houses during the first six years of the Bush administration, a period characterized by the disgraceful decision to allow a decade-old assault weapons ban to expire in 2004 and successive energy bills focused on maximizing fossil fuel production at the expense of the environment.
It would be nice to think that the broad Republican support for a progressive energy bill signaled a pro-environment change of heart. Unfortunately, it probably has more to do with the high price of oil; Republicans are feeling pressure to bring gas prices down. They also rightly see dependence on foreign oil as a national security issue. The fuel economy bill would increase the average mileage requirement for cars sold in the U.S. from 25 miles per gallon to 35 by 2020, expected to eventually save millions of barrels of oil a day.
Regardless of their motives, Republicans' support for the energy bill will increase pressure on President Bush to sign it, assuming it gets through the House. Bush favors better fuel economy but wants it to come at a slower pace, with loopholes to allow more gas guzzling by SUVs. The Senate energy bill has its own regrettable loophole: A strong mandate was watered down in committee, allowing federal regulators to cancel the improvements if they decide the tighter standards aren't "cost-effective." But senators beat back furious efforts by the auto industry to weaken the bill further.
There was one sour note to last week's passage of the energy bill: An amendment that would have required the nation to get 15% of its electricity from renewable sources was defeated. Senate leaders should revive it in the future.

USCIS has once again updated its announcement regarding the number of H-1B petitions received and counted towards the H-1B cap. As of May 4, USCIS has received approximately 45,000 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. As such, USCIS continues to accept petitions subject to the general cap. Additionally, that USCIS has received approximately 20,000 petitions for aliens with advanced degrees remains unchanged. Hi all,
My wife was laid off a couple of days ago. She has efiled H1->H4 status change application which recommended by HR. However she needs out of USA because of family issue next month. She has valid AP.
Here my questions:
When she travel outside of U.S. before the H1-> H4 change application is approved, her application for status change is automatically canceled/invalid. Is that true?
2. She only could use AP to re-enter USA. She needs to resubmit H1->H4 after she back USA. Should she cancel the previous one? If any effect on her I-485 application?
3. Is any premium process for H1->H4?

Have valid EAD [me and wife] but never used it. Still on H1B and H4 respectively.
I am on second term H1B which expires on Oct-2010.
Project is ending and I have to find new job. Current company applied for EAD renewel last week. But didn't want to spend for H1B renewal since I might change jobs. I am planning to invoke AC21 and shift to similar job. I want to know what is the last date for me to renew/port my H1B ?
My wife used her Advance Parole for travel [but did not use EAD for job], does that mean she is not in H4 anymore ?

My wife filed I-539 for changing status from H-4 to F-1 at end of May. We have the receipt and the case is now pending. Is it possible for her to request cancellation of this change of status and continue in H-4 status? If so, does anyone know how to ask USCIS for this?

My finger printing was done in Sep-2007 .....took an Infopass and opened a SR .The IO officer @ infopass said that the finger printing has to be initiated from Nabraska...any body on the same boat

I am currently starting a language institute in California. I incorporated the organization 2 years ago, but I am starting it now. I want to hire a Brazilian national on an h2b visa to teach Portuguese but I am worried that as I am starting the business now and haven't generated income yet I won't be allowed to hire this teacher. Is this something I should worry about? Thank you for any help. I appreciate it.
