I have an approved 140 with Sept 2005 PD
I have an I 140 and I 485 filed with Dec 2006. There is an RFE on this. I want to interfile I 485 with the approved I 140. Is there a possibility and if so what needs to be done.
I have submitted the response to the I 140 RFE. May be I will get a response in 2-4 weeks.
However, if the I 140 gets denied can I still Interfile my 485 with ealrier approved 140?
What are the options open for me to keep my 485 alive?

I hyphenated my name while I was applying for a green card. All of my Canadian documents like my passport and my Canadian photo ids like my Ontario drivers license and health card are all in my maiden name. Can I bring my green card alone with no other documents or do I need some other government issued id? The only thing that has my current name is my green card. What do I need to get a license.

If i get you right, what you are asking is H1 to F1 conversion, why it is not possible ?
It is possible provided if one is maintaining his or her H1 status, till requesting to convert to F1.

Ok, winter is winding up and summer is here..:):)
There is going to be lots of Indian cultural festivals/Independence day celebrations etc, etc... many opportunities to meet many EB immigrants in these festivals....I have lived in Texas and easily 10k people go to Anand Bazaar (India�s Independence day celebrations)
If all the State chapters co-ordinate a membership campaign, it will be a great success...We should aim at 100k count by this fall..
CAN WE DO IT, let me hear a big YESSSSS ?
We have to come out with a nice one page IV brochure, probably printed in a press in recycled paper (cheaper/good for environment) and circulate in all these functions /festivals. The brochure should explain who we are/what we do/what we have achieved so far(lot), and how EB immigrants will get immense benefit from our forums etc etc...

I am working on H1B visa as full time employee (Business Analyst) for a global manufacturing company. After going throughforums I understand that as consulting employees need client letters, similarly full time employees need in house project documentation for visa stamping. I work in IT department of my company where we maintain applications and provide production support and there is no specific project that I am working on. Should full time employees must have in house project documentation for visa stamping? Will I have any problem if I tell VO that I provide production support and am not working on a specific 1 project?

My friend's company is India recently applied for his L1B visa. He is scheduled to go for stamping next week. But, another company has already premium-filed his H1B petition and is expected to hear back from the USCIS anytime now.
Here's the question: if he gets his L1B visa first, can he later on try and get his H1B visa and enter the country with the H1 visa? Second, if he goes for H1B stamping with an L1 visa already in his passport, will it affect the visa officer's decision in issuing a H1 visa?
Please chime in if anyone has done this before or has any insight on this matter.

USCIS used to have a lot of difficulty raising fees and would only get increases approved every few years. They now raise their fees frequently and have just announced their intentions to do so again. My wife came to the US on a H4. She got her H1 approval in October 07 and started working for the consulting firm that sponsered the H1. She also got a consulting position in a company. But her SSN was not issued until Jan 08. So the consulting company cannot gerenate payroll for Oct, Nov and Dec of 2007. We are planning to goto India in May and also get our Visas stamped. Any ideas on whether we will run into problems when we go for stamping, since she will not have a W2 for 07. Also will the paystubs from 2008 suffice at the consulate? Do we have to tell the consulate that she started working in Oct 07 or can we just say she started in Jan 08 will this create a problem of why did she not strat working as soon as her petition was approved in 07.

Does anyone know if EAD renewal requires an employment at the time of renewal? My I140 have been approved and I485 pending for long time under EB2-NIW. Also, do I loose legal status to stay in USA if I lost employment while my I485 pending. Again, my GC application is not company sponsored, it was all by myself. Do I stay in right status even I become unemployed while my I485 pending. My I485 will be pending for few more years due to retrogession. So I am wondering if I can stay as unemployed for a period of time while my AOS pending.
Also, do I need to have an employment while re-entering using AP? I recently used my EP to re-enter but no question was asked about employment. I am thinking if I can use AP for re-entry if I travel outside while I am unemployed. I have to think about all this options as chaotic situation is going on the company and layoff might be inevitable.

My attorney filed I-140 on July 5th. No receipt yet. No news also.
He said he cannot send it to TSC, instead he mailed it to NSC. Is that the standard filing place?
