Hello Michigan IV Members,
I would like to request all IV members living in Michigan to please respond to this thread. We would like to make the MI chapter much more active in our mission to solve many of the problems we face as legal immigrants. I think as a cohesive group, we'll be able to make a greater impact. So pls join me, Samrat, Jagan, Shailendra, Puneet, Amit, and many other active members in MI to make it happen. You need to have a labor application filed (need not be approved) 365 days before the expiry of the 6th year in order to get the 7th year extension.

Yes, You can file for H1 extension and they will give you extension for the remaining period of 6 years.
FYI, total days of 6 years are counted based on your presence in US. so, even your out of US periods also can be recaptured.

I was working for company A in US till June 2008. I had to return to India in July 2008 due to personal reasons. My 6th yr on H1b expired in October 2008.
I am now in India and applying for 3yrs H1b extension based on my approved I140 with company B. My I485 was filed in august 2007. I do not have US pay stubs since July 2008 as I did not work in US.
Has anybody been in a similar situation? What are the chances of getting approval? Once I get I797 approval, should I expect further challenges in getting visa stamped in India?

Supposed my I-485 was approved, am I legally required to go to USCIS, surrender my I-94 card and get a I-551 stamp? Could I just wait for GC to come in the mail?

Hello, I really appreciate a lot if anyone here could help me on this..
The company I have been working with an H1B for a years got recently restructured to a new firm and it filed a H1B transfer for me this Feb. The petition got an RFE and the firm made an Appeal, which is now pending. The job looks now rather unsecure and I am not sure if the company will continue sponsoring me for a new H1B if this transfer got denied in the worst case scenario..
So my questions are:
1. Can I file a COS to F-1 while my H1B transfer appeal is still pending?
2. If my H1B transfer appeal got rejected, or I got laid off while it's still pending, after that happened is it still possible and in time to file a COS to F1?
I am really worried about my current situation now, and thank you very much if you could kindly help on it!

If any one is a client of Cohen and Grisby and looking to appliy AOS now, have you heard anything from them asking for forms and docuements or when they will start submitting the applications.
I looked at their website and they haven't posted a thing, nor have they sent an e-mail, like they sent after the first July bulletin came out in June.
I was wondering if any one is in same situation as I am. By the way I already tried to reach them, but could not get through.

I need to renew my H1 for the 9th year and was wondering if I need to pay the ACWIA fee of $1500. It seems employers who are filing for a 2nd extension are exempt from paying. Does it apply also to cases beyond the 2nd extension?

I have a difficult situation , i have a H1B expiring in 5 Days and also ending the 6 yr period. My company is filing a H1B to L1A conversion application from US in premium processing
1. Is it legal to stay until L1A is approved? for duration of 2 weeks until L1 Premium processing is done
2. In L1A is rejected, would it be legal to travel citing the rejection of L1 petition
Please help me with any insight you may have
Just want to add that , the company is asking me to go on an admin leave for the period

I have been reading some posts since yesterday. I still haven't been able to get a confirmed clarification.
If I am on H1, and change my status on H4 for lets say 8 months. Then decide to start working again on H1, would I be counted against the cap again?
I have been reading some posts which says if I have been counted against the cap once in last 6 years, I won't be counted again. Does that apply when one changes visa status from H1 to H4, and then back to H1.
Has anybody done this successfully. Can you point to some clarification or law from USCIS itself?

Current EAD was supposed to expire in Feb so applied 100 days ahead for renewal. To my surprise application got approved in 10 days:D. Hope they've given for 2 years and starting from expiry date of current one....

H1b from non-cap to cap cannot be transfered. In order for you to work in private companies, you need to get new H1b by filing in on april 1 st 2009 which will ahve start date of oct 2009. Untill then you are stuck ..!!!
However you can transfer your present H1b to another non-profit h1b. I know the rules sucks..I ahve been in your place and got H1b this time. Can't wait to to get freedom on oct 1st.
