Hi,
I have applied I-485 in July 2007. My Priority date is May22, 2006 (which is current as per August VISA Bulletin). But I haven't received the Finger Printing notice yet !!
I also went to Local Office but they also couldn't help me.
What I am suppose to do in that case?

I wonder how will the June\July bulletin change the job market - for technocrats...
Starting from Dec 1st many people will be eligible to switch jobs...people who were unable to do so till now.
And in Jan- many more will get into the "green" zone...
So here is the poll question:
Are you planning to change jobs ?:)
A: As soon as possible- Cant wait !!!
B:Yes- but not immediately - as soon as I find something good
C:Not Really- I am content where I am.

It is clearly stated in the I-485 instructions that parents should sign for children below 14 years of age. Those 14 and above should sign for themselves.
Do we need to sign the I-485 docs on behalf of minors? My daughter is 9 years old and she has signed her papers all by herself. When I asked my attorney, one time she said I need to sign and finally she sent the docs with her signature only.

Hi Friends,
I have approved I-140 (PD Sep,2007) but recently my H1 extension was denied so had to come on H4, so now what will happen to my GC, do I have to start from scratch OR my I-140 is still valid once I come back on H1 (with different employer).

I applied for AP and EAD renewal in July 2010. I need to go to India by Oct 1st week for some personal work which can not wait beyond that time.
I am planing to expidite my AP if I wont get AP by then. What can I do with my EAD?
- Do I need to be present in US for EAD or I can leave US and ask my friend send EAD to India when it gets approved?
- If I go to India before EAD approval and if I am called for finger printing what are my options? Like, if I dont/cant come by the finger printing appointment date what happens ?
I appreciate for your reply.

I am on H1B all these days and now my company wants me to mandatory move to EAD. (no option here). I also had my H1B approved for an other 3 years.
1) Is it a good idea to move on EAD now.
2)Its been close to 6 years on my H1 but I still have 8 months left on the initial 6 years. Can i use the left out period on H1B later.
3)Now that I am on EAD, if i need to move my employer, can I invoke the AC21. if yes what should I do... do i just need to resign at the current place and join at the company b.
4)Can my employer revoke the I140, considering that its already been more than 180days since approved.

My H1-B visa ended on December 31, 2009. I applied for a change of status to F1 visa on December 21st, 2009 towards the Spring 2010 (Jan 2010) semester. I received an RFE stating that I need to send a new I-20 for a valid future semester.
Assuming this new I-20 is for Summer 2010 (May 2010), my question is as follows - If my change of status to F1 gets approved and my semester starts 2 months later, am I allowed to legally stay in the country?

Hello,
I recently received my Greencard. Will be getting married in a few months and wanted to find out the options available to sponsor my fiance. Fiance is a british citizen, does that help in any way? Also she is a qualified Doctor in the UK and is planning on taking USMLE part 1 & 2 prior to the wedding. Is it prudent to have her move to the US on an H1B instead?

I am in a weird situation here, I was Laid off on July 21st with pay in lieu until 4th August. I had applied for Change of Status to F2 (my wife is on F1) on 17th August. On 31st August I got a job offer and applied for H1B transfer to USCIS on 8th September (using 15th august paystub as the latest).
At the same time i filed to USCIS to revoke my F2 application.
Today I got a notice from USCIS that my application for change of status to F2 is approved as of 09/21/2009.
Now, I dont know what to do, does it mean I am now on F2? Is my H1B transfer application still valid or I need to apply again this time on premium processing.
What should be my next course of action. Any help in this regard would be highly appreciated.

I was laid off from Company A on H-1B in May 09. My EB2, India, I-140 was approved in Mar 09. Since PD is not current, I-485 has not been filed yet. Here are my questions:
Can I retain my PD if Company A withdraws(worst case) my I-140 petition?
If I find employment with Company B, can I still file my I-485 using Company A's I-140 petition assuming Company A provides me with an Employment Letter for future employment?
If previous step is feasible and I-485 is approved within 180days of filing, will it pose any issues if I have to invoke AC21? (since I will be working for Company B when I file I-485 with Company A) I ask this because I have 2 yrs and 4months on my H-1B off the 6yr limit and I am afraid I might run out of H-1B time before I file I-485.
