There is no mandate about that....They can come back anytime before Aug 17 as long as their PD is on or before July 31st, 2007.....Since USCIS said it will not reject 485s without medicals, you can get the medicals done later and submit when they send you an RFE....However, make sure to keep all the applications filled in and ready for mailing except for the signatures and I-94 information of the returning individuals......

I am working for a small company on H1B since October 2006. The company had originally filed for full time employment (LCA and I-129) but at the time of hiring offered part time employment. I worked part time till June 2008 and since then I have been working full time. The company however never filed for an amended LCA and/or I-129. My H1B approval was extended last October by another 3 years. I also work part-time for a University on a concurrent H1B.
Will I be deemed out of status for this? What are the implications of this on filing for GC under EB1 or EB2? Is there any way in which this situation may be legally rectified?
Please advise.

Hi all,
I need some good advice and facts...
My friend's H1-B extension is approved but the stamping (Mumbai consulate) might get denied due to a previous (dismissed) charge for driving with suspended license.
What are the options after that? Can he re-apply for the visa stamping again using the same H1-B approval petition? Can we appeal the decision since it document clearly states that the fine was paid?
Please advise.

Company -A - EB3 - PD of March 2003
Company -B - EB2 - PD of March 2006 (PERM)
I got my Labor, I -140 from company B, and applied for 485 recently (July-2nd).
Recently (Last week) I got the labor approved from Company A (as it went to Backlog).
I was thinking that If I get I-140 from Company A then, My layer wants to use that Priority date in already filed 485 case.
But to get the I-140 from the Company B, I may have to spend around 3k, so just thinking if it is worth doing or not.
Any suggestions?

My RIR labor was filed and have a PD of Nov 2004. It was stuck in BEC and my company decided to file my PERM in 2006. Now my I-140 based on PERM application was just filed, when my RIR based labor was approved. My 6 yrs of H1 exp Feb next year. I can't file my RIR based I-140 as my PERM based I-140 is already filed. So I'm planning to premium process my perm based I-140. Also my comany will file I-140 based on my RIR application for better PD . My questions are:
1) If I get 3 year extension based on PERM based I-140, will there be some problem in future if I change my company and try to use my RIR based PD (after I140 approval)
2) or should I premium process my RIR bases I-140 also (after getting my current PERM I140 approved), so that I can file my H ext based on RIR applications to avoid any problems in future for PD retension

I applied for my concurrent filing during the July 07 fiasco. My I-140 is still pending approval. I am hoping that it gets approved within the next month or so...my question is ...when can I switch companies for a same/similar job if I wanted to? Since my I 485 has been pending for over 180 days do I need to wait for my I-140 approval? if I do have to wait, can I switch as soon as I get my 140 approval?

I worked for a company A from Dec 2005 to Feb 2007 and then I switched employers, and I was between projects. The next company I started working for gave me an offer letter only when I found a project (May 2007). So technically there is a 2 month gap. Even the experience letters from that company says I have started work from May 2007.
I'm not sure if this will cause a problem in my I140 stage. Kindly advice.
I have changed two companies after that and I'm filing my GC through the current company. Any response will be much appreciated.
